What is cyber crime
• “Cyber Crime” is any offence where electronic communications or
information systems, including any device or the Internet or both or
more of them are involved
• Cyber crime is used to define criminal activity in which computers or
computer networks are
– a tool,
– a target, or
– a place of criminal activity
• Cyber Crimes can be categorized in two ways:
– The crimes in which the computer is the target. Examples of
such crimes are hacking, virus attacks, etc.
– The crimes where the computer is used as a weapon. Examples
include cyber terrorism, IPR violations, credit card frauds, etc.

Types of Cyber Crime
• Hacking – One of the most common and oldest forms of
cybercrime, which general refers to unlawful access to a computer
system. Includes breaking the password protected websites,
circumventing password protection on a computer system or use
of faulty hardware or software implementation to illegally obtain a
password to enter a computer system.
• Identity Theft - a person fraudulently obtains another person’s
personal information and uses it primarily for economic gain. This
could include marketing calls, bank calls, etc. Creating Social
Networking accounts in someone else's name
• Software Piracy - Use of pirated software, distributing pirated
content, copying or duplicating the software and claiming it to be
their own

Types of Cyber Crime
• Cyber Stalking – cyber stalking involves the repeated pursuit of
an individual using electronic or internet capable devices. Some
instances of cyber stalking includes threatening, coercive or
intimidating electronic communication.
• Hate Speech Online – The anonymity of internet allows a
miscreant to easily spread false and offensive ideas. These ideas
need not always incite violence but they might deal with
discriminatory attitudes prevalent in the society.
• Fraud and Financial Crimes – Crimes related to bank transaction,
credit card, online transactions, and e-commerce related
transactions, etc.

• Phishing – It refers to a form of online identity theft that
aims to steal sensitive information such as online banking
passwords and credit card information from users. This
includes email, calls or messages luring someone to provide
personal information, financial or identity information
• Cyber Terrorism –Internet terrorism includes acts of
deliberate, large-scale disruption of computer networks, by
the means of tools such as computer viruses. Also includes
hacking into government records, confidential information,
military, etc.

Legal Protection in India
• Information Technology Act, 2000 was enacted.
• IT Act is considered one of the most important laws
that deals with the digital crimes or cyber crimes
and electronic commerce.
• Most of the cyber crimes dealing with offences
relating to the use of or concerned with the abuse
of computers or other electronic gadget are listed
under the Information Technology Act (IT Act),
2000, but some crimes are dealt with under the
Indian Penal Code.

The Information Technology Act, 2000

The Information Technology
Amendment Act
• The Information Technology Act, 2000, was thus passed as
the Act No.21 of 2000, got President assent on 9 June and
was made effective from 17 October 2000.
• Major industry bodies were consulted and advisory groups
were formed to go into the perceived void in the I.T. Act
and comparing it with similar legislations in other nations
and to suggest recommendations. Such recommendations
were analysed and subsequently taken up as a
comprehensive Amendment Act
• This Amendment Act got the President assent on 5 Feb
2009 and was made effective from 27 October 2009.

Conclusion
• While there are many legislations not only many Western
countries but also some smaller nations in the East, India
has only one legislation -- the ITA and ITAA.
• Hence it is quite natural that many issues on cyber crimes
and many crimes per se are left uncovered.
• Also it may be noted that most of the cyber crimes in the
nation are still brought under the relevant sections of IPC
read with the comparative sections of ITA or the ITAA which
gives a comfort factor to the investigating agencies that
even if the ITA part of the case is lost, the accused cannot
escape from the IPC part.
