1. Adultery
Even though it is no more a penalized crime,
adultery shall be considered as a ground for divorce
when it fulfils the following conditions
1. One of the spouses involved in the intercourse
with another person, married or unmarried, of the
opposite sex.
2. Intercourse should be voluntary and consensual.
3. At the time of the act, the marriage was subsisting.
4. There must be sufficient circumstantial evidence
to prove the liability of another spouse.

2. Cruelty
The concept of cruelty includes both mental and physical cruelty.
Physical cruelty is easy to determine, but mental cruelty shall be very
subjective to decide. Some instances are:
1. false accusations of adultery
2. demand of dowry
3. refusal to have marital intercourse/children
4. impotency
5. birth of child
6. drunkenness
7. threat to commit suicide
8. wife’s writing false complaints to the
employer of the husband
9. incompatibility of temperament
10. irretrievable breakdown of marriage

3. Desertion
Desertion basically means a total repudiation of marital obligation
where one party rejects all the obligations of marriage and
abandonment the spouse without any reasonable cause or consent.
The following 5 conditions must be present to constitute
desertion;
1. the fact of separation
2. animus deserdendi (intention to desert)
3. desertion without any reasonable cause
4. desertion without the consent of another party
5. Statutory period of two years must have run out
before a petition is presented

4. Conversion
Conversion of one of the spouses to any other religion affords a
ground to the other spouse certain matrimonial reliefs. In this
context, conversion means that the person has voluntarily
relinquished his or her religion and adopted another religion after
going through some formal ceremony.
The Hindu marriage act has proposed two conditions when
conversion as a ground for divorce can be invoked, these areas.
1. That the respondent has ceased to follow the faith of
Hinduism, that is he is no longer a Hindu
2. That the respondent has converted to another religion that
is a non-Hindu faith.

5. Insanity
A marriage cannot be sustainable until and unless both the parties
equally discharge their duties and take up responsibilities. It shall
be very stressful even if one of them are unable to do the same.
This shall happen in case one of the spouse has an unsound mind
or has been insane.
Insanity as a ground of divorce has the following two
requirements-
1. Has been incurable of unsound mind
2. Has been suffering continuously or intermittently from a
mental disorder to an extent that the spouse cannot
reasonably be expected to live with the partner.

6. Leprosy and Venereal Diseases
Contagious diseases like leprosy and STD’s were
initially considered as a ground for divorce under Hindu
Marriage Act, but later in the year 2015 on the
suggestion of the United Nations Organization, they
were held to be invalidated

7. Presumption of death
Under the Act, a person is presumed to be dead, if
he/she has not been heard of as being alive for a period
of at least seven years. The burden of proof that the
whereabouts of the respondent is not known for the
requisite period is on the petitioner under all the
matrimonial laws. This is a presumption of universal
acceptance as it aids proof in cases where it would be
extremely difficult if not impossible to prove that fact. A
decree of divorce granted under this clause is valid &
effective even if it subsequently transpires that the
respondent was, in fact, alive at the time when the
decree was passed.

8. Renunciation
“Renunciation of the world” is a ground for divorce only
under Hindu law, as the renunciation of the world is a
typical Hindu notion. Modern codified Hindu law lays
down that a spouse may seek divorce if the other party
has renounced the world and has entered a holy order. A
person who does this is considered as civilly dead. Such
renunciation by entering into a religious order must be
unequivocal & absolute.

8. Renunciation
“Renunciation of the world” is a ground for divorce
only under Hindu law, as the renunciation of the world
is a typical Hindu notion. Modern codified Hindu law

Conversion Conversion of one of the spouses to any other religion affords a ground to the other spouse certain matrimonial reliefs. Presumption of death Under the Act, a person is presumed to be dead, if he/she has not been heard of as being alive for a period of at least seven years. The burden of proof that the whereabouts of the respondent is not known for the requisite period is on the petitioner under all the matrimonial laws. This is a presumption of universal acceptance as it aids proof in cases where it would be extremely difficult if not impossible to prove that fact.
