INTRODUCTION
The Hague Apostille Convention is officially known as The Hague
Convention of 5 October 1961, Abolishing the Requirement of
Legalisation for Foreign Public Documents. It was drafted by the Hague
Conference on Private International Law (HCCH) and has been signed by
about 116 countries.

emanating from a public prosecutor, a clerk of a court or a
process-server (“huissier de justice”)

APOSTILLE IN INDIA
● India, since 2005, is a member of the Hague Convention of October 5,
1961 that abolished the requirement of legalization of foreign public
documents.
● Apostille is done for personal documents like birth/death/marriage
certificates, Affidavits, Power of Attorney, etc. and educational
documents like degree, diploma, matriculation and secondary level
certificates etc. Any document Apostilled in one member country is
acceptable in all the other member-countries, signatory to the referred

certificate, issued by the Secretary of State.

LEGALIZATION
● A state that has not signed the Convention must specify how
foreign legal documents can be certified for its use.
● The document must be certified by the foreign ministry of the
country in which the document originated, and then by the
foreign ministry of the government of the state in which the
document will be used; one of the certifications will often be
performed at an embassy or consulate.
● In practice this means the document must be certified twice
before it can have legal effect in the receiving country. For
example, as Canada is not a signatory, Canadian documents for
use abroad must be certified by the Deputy Minister of Foreign
Affairs in Ottawa and subsequently by the relevant government
office or consulate of the receiving state.

• The Ministry of External Affairs apostille is mandatory for
people who wish to move abroad. It is the authentication done by
the ministry of external affairs which is a government body.
• MEA apostille must be sent along with the documents and it is
accepted only in countries which are part of the Hague
convention. This MEA apostille can be used in all the member
countries of the convention.

The Convention has also proven very useful for countries that do not
require foreign public documents to be legalised, or that do not know
the concept of legalisation in their domestic law.
The citizens in these countries enjoy the benefits of the Convention
whenever they intend to produce a domestic public document in
another Contracting Party which, for its part, requires authentication
of the document concerned.
