These are the slides of the presentation that my colleague, Joseph Dalby of the IP and Tech Law Group of 4-5 Gray's Inn Square, gave to the monthly arbitration forum of the Irish branch of the Chartered Institute of Arbitrators. Joseph had helped to set up the Irish domain name dispute resolution policy and he discussed it in some detail highlighting some of the differences between the Irish policy, the ICANN Universal Domain Name Dispute Resolution Policy ("UDRP"), the Nominet Dispute Resolution Service Policy and the Czech Court of Arbitration Rules for the resolution of disputes in the ".eu" top level domain name space. Joseph also discussed the legal issues likely to arise from the new generic top level domain names.

Although the process for registering domain names is a separate one from trademark registration, many countries have reached the conclusion that there is a strong need to take precautionary measures to prevent conflicts between trademarks and use of domain names. Nigeria has, with the recent passing of the Cybercrimes (Prohibition, Prevention, Etc) Act 2015 joined the moving train in adapting its trademarks protection framework to the exigent demands of participating in the network of computers on the World Wide Web. This paper examines the concept of trademark infringement, cybersquatting and the use of domain names, as well as considers the appropriateness of an action for trademark infringement or passing off in the event of a dispute arising from use of domain names.

Cybersquatting (also known as domain squatting), according to the United States federal law known as the Anticybersquatting Consumer Protection Act, is registering, trafficking in, or using an Internet domain name with bad faith intent to profit from the goodwill of a trademark belonging to someone else. The cybersquatter then offers to sell the domain to the person or company who owns a trademark contained within the name at an inflated price. The term is derived from "squatting", which is the act of occupying an abandoned or unoccupied space or building that the squatter does not own, rent, or otherwise have permission to use.

The microservices honeymoon is over. When starting a new project or revamping a legacy monolith, teams started looking for alternatives to microservices. The Modular Monolith, or 'Modulith', is an architecture that reaps the benefits of (vertical) functional decoupling without the high costs associated with separate deployments. This talk will delve into the advantages and challenges of this progressive architecture, beginning with exploring the concept of a 'module', its internal structure, public API, and inter-module communication patterns. Supported by spring-modulith, the talk provides practical guidance on addressing the main challenges of a Modultith Architecture: finding and guarding module boundaries, data decoupling, and integration module-testing. Tracing the root cause of a performance issue requires a lot of patience, experience, and focus. It’s so hard that we sometimes attempt to guess by trying out tentative fixes, but that usually results in frustration, messy code, and a considerable waste of time and money. This talk explains how to correctly zoom in on a performance bottleneck using three levels of profiling: distributed tracing, metrics, and method profiling. After we learn to read the JVM profiler output as a flame graph, we explore a series of bottlenecks typical for backend systems, like connection/thread pool starvation, invisible aspects, blocking code, hot CPU methods, lock contention, and Virtual Thread pinning, and we learn to trace them even if they occur in library code you are not familiar with. Attend this talk and prepare for the performance issues that will eventually hit any successful system.
