Executive Order No. 180

  1. 1. EXECUTIVE ORDER NO. 180 (June 01, 1987) Scope: Applies to all employees of all branches, subdivision, instrumentalities and agencies of the Government including government-owned or controlled corporations with original charters. (Section 1) All government employees can form, join or assists employees’ organization of their own choosing for the furtherance and protection of their interests. They can also form, in conjunction with appropriate government authorities, labor-management committees, works councils and other forms of workers’ participation schemes to achieve the same objectives. (Section 2)

EO # 180 ……………… cont. …. <ul><li>Government employees shall not be discriminated against in respect of their employment by reason of their membership in employees’ organization or participation in the normal activities of their organization. Their employment shall not be subject to the condition that they shall not join or shall relinquish their membership in the employees’ organizations. (Section 5) </li></ul>
  3. 3. EO # 180 ….. cont. ….. <ul><li>Government authorities shall not interfere in the establishment, functioning or administration of government employees’ organizations through acts designed to place such organizations under the control of government authority. (Section 6) </li></ul>
  4. 4. Rules Implementing EO # 180, As Amended (March 16, 2005) <ul><li>Rule XII – COLLECTIVE NEGOTIATIONS </li></ul><ul><li>Terms and conditions of employment or improvements thereof, except those that are fixed by law, may be the subject of negotiations. (Section 1) </li></ul>

Rules Implementing EO # 108 <ul><li>The following concerns may be subject of negotiation between the management and the accredited employees’ organization: </li></ul><ul><li>Schedule of vacation leave and other leaves. </li></ul><ul><li>(b) Personnel growth and development </li></ul><ul><li>© Communication system – internal (lateral and vertical), external </li></ul>

Rules Implementing EO# 180 <ul><li>(d) Work assignment/re-assignment </li></ul><ul><li>detail/transfer; </li></ul><ul><li>(e) Distribution of work load; </li></ul><ul><li>Provision for protection </li></ul><ul><li>(g) Provision for facilities for handicapped personnel </li></ul><ul><li>(h) Provision for first aid medical services and supplies </li></ul><ul><li>(i) Physical fitness program </li></ul>

Rules Implementing EO# 180 <ul><li>(j) Provision for family planning services for married women; </li></ul><ul><li>Annual medical/physical examination; </li></ul><ul><li>Recreational, social, athletic and cultural activities and facilities. </li></ul><ul><li>CNA incentive pursuant to PSLMC Res. No. 4, s. 2002 and Resolution No.2, s. 2003, and </li></ul><ul><li>Such other concerns which are not prohibited by law and CSC rules and regulations. (Section 2 ) </li></ul>
  8. 8. Rules Implementing EO# 180 <ul><li>Increases in salary, allowances, travel expenses and other benefits that are specifically provided by law are not negotiable. (Section 3) </li></ul>
  9. 9. Rules Implementing EO# 180 <ul><li>Nothing herein shall be construed to prevent any of the parties from submitting proposals regarding other matters to Congress and the proper authorities to improve the terms and conditions of their employment . (Section 5) </li></ul>
